Why are past convictions appearing on my police check?
There are numerous reasons why previous convictions may appear on your police check, including:
- If you're required to work with children or vulnerable individuals like the elderly, the spent conviction laws may not apply due to the check having Child/Vulnerable Rules applied.
- In Western Australia, offences are not automatically spent and need to be applied to the magistrates' court for removal if applicable.
- If you have repeated offences or similar offences, they may appear on the police check.
- The State/Territory Police Agency who conducted the manual review process may have deemed it necessary under legislation to include certain records on the police check due to the nature of the purpose for the police check e.g. role or industry you’ll be working in.
If you do not believe these results should appear in your police check, we can lodge a dispute with the relevant police agencies on your behalf. If you wish for us to lodge a dispute, please send an email to support@checked.com.au. You will be required to provide your Check ID, starting with “9” or “1”. You will also need to send a description about the offence and what specifically shouldn't have been disclosed.
The relevant police agencies will review the information and reassess whether that offence should have appeared on your check.
